Debt Collection 2In the current economic climate no business can afford to allow a debt go unpaid to the detriment of the trading cash flow and end of year accounts.  If monies remain unpaid for any period of time up to 6 years certain legal steps can be taken to recover these debts.

Burke Solicitors are experienced debt recovery litigators.  Acting on your instruction we can pursue the Debtor for the Debt in question and if payment is not secured we will apply to the relevant Court (District Court, Circuit Court or High Court) for Judgement to be marked against the Debtor.


Once a Judgement has been recorded against any person there are a number of ways to “enforce the debt” in order to secure payment if it is not forthcoming immediately such as:-

  • Registration in the Judgements office;
  • Publishing in the Stubbs Gazette;
  • Registering a Judgement Mortgage;
  • Seeking an Instalment Order;
  • Directing the local Sheriff to attend at the debtor’s home to request payment and/or seize goods of value;
  • Attachment and Committal Order, where appropriate;
  • Garnishee Order

We also offer advice and legal representation to persons who are the subject of debt collection proceedings.  In this regard is it undoubtedly better to address the problem head on than to attempt to ignore and avoid the issue.  We will assist you in negotiating the most favourable outcome and protect your best interests wherever possible.
